This Terms of Use Agreement sets forth the standards of use of the x4Golf Website Service for Registered Users. Registered Users are also known as "Members".
1. Description of Service
x4Golf provides Members with on-line golf software programs. An internet connection is required to use these programs.
Fees charged by x4Golf are referred to as Subsciption Fees. The golf software programs are subject to annual Subscription Fees to operate the programs.
2. Disclaimer of Warranties.
Golf software programs are provided by x4Golf on an "as is" basis. To the fullest extent permitted by applicable law, x4Golf makes no representations or warranties of any kind, express or implied, regarding the use of these programs.
3. Limitation of Liability
x4Golf SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR x4Golf SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THIS PROGRAM OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE.
4. Compliance with Laws
The Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the program in any way that violates applicable state, federal, or international laws, regulations or other government requirements.
5. Copyright Information
This program is copyrighted, 2022 x4Golf.com, with all rights reserved and is protected by intellectual property rights. Any use of this program, including reproduction, modification, distribution, replication, or other commercial exploitation of any kind, without prior written permission of an authorized officer of x4Golf is strictly prohibited.
6. Notification of Claimed Copyright Infringement
Pursuant to Section 512(c) of the Copyright Revision Act, as enacted through the Digital Millennium Copyright Act, notifications of claimed copyright infringement may be sent to x4golf.com using the contact link above.
7. Member Agreement
When using x4Golf on-line golf league programs, the Member agrees:
Not to upload, post, email or transmit otherwise any material that contains software viruses, trojan horses, worms, files or programs intended to interrupt, destroy, deface or limit the use, access or functionality of x4Golf on-line golf league programs.
Not to upload, post, email or transmit otherwise any material that is illegal, pornographic, abusive or obscene.
Not to upload, post, email or transmit otherwise any material that violates the privacy or intellectual property rights of others.
Not to "Reverse Engineer", change, modify, hack, translate, copy, distribute, pledge, assign, transfer, make derivative works, exploit, encumber or crack any portion of the x4Golf on-line golf league programs.
x4Golf in its sole discretion, may remove content and block user access to any content that it determines to be illegal, threatening, pornographic, abusive, obscene or in violation of another party's intellectual property.
